ORDER APPOINTING COMMISSIONER PURSUANT TO S.J.C. RULE 4:01, § 14
This matter came before the court, Georges, J., on a Petition for Appointment of Commissioner pursuant to S.J.C. Rule 4:01, § 14, and the Affidavit of Michelle R. Yu, Legal Program Attorney for the Board of Bar Overseers (Board) filed by the Board on December 9, 2025. Upon consideration of the papers, It is ORDERED that the Petition for Appointment of a Commissioner be, and the same hereby is, ALLOWED, and that Attorney Michelle R. Yu, be appointed to serve as Commissioner for Attorney Bernard W. Fang, formerly of Charlestown, Massachusetts. Attorney YU shall act in accordance with S.J.C. Rule 4:01, § 14 and may request of this Court such further orders as may be necessary or appropriate in fulfilling her duties. It is FURTHER ORDERED that the Commissioner: 1. shall at reasonable times and places have full access to
all records, files, and bank trust accounts of Bernard W. Fang; 2. shall take control and possession of all IOLTA, client, fiduciary, and other trust accounts standing in the name of Bernard W. Fang, if any, and upon receipt of those funds, shall properly disburse or otherwise transfer those funds to the client or third party entitled to receive same;
3. shall take control and possession of all remaining client files of Bernard W. Fang and take whatever action is reasonably necessary or appropriate to protect the interests of clients of Bernard W. Fang;
4. shall take appropriate action to protect the interests of other persons who have interests in estates, trust, and other matters as to which Bernard W. Fang may have been the fiduciary, including but not limited to filing Suggestions of Death in the applicable divisions of the Probate and Family Court, taking all reasonably necessary steps to effect the appointment of successor fiduciaries consistent with the terms of any applicable Will or Trust or the requirements of law and providing notices to the appropriate parties of the Mr. Fang’s death and the effect thereof;
5. shall, upon sending notice to the active clients, if any, to retrieve their files and that unclaimed files will be subject to destruction, be authorized to destroy any unclaimed or closed files upon request of the client or his/her counsel or as permitted by
Mass. R. Prof. C. 1.15A, whichever happens first; and
6. shall, on completion of her efforts, file a report with the office of the Clerk for the Supreme Judicial Court for the County of Suffolk describing and documenting her efforts pursuant to this Order.
